BMW involved in a fatal traffic accident, which took in Dushanbe Wednesday evening leaving four dead and two injured, was driven by a traffic police officer, Major Orzoubek Habibzoda, according to the Dushanbe Main Police Directorate.

He was reportedly driving at a speed of more than 100 kilometers per hour.  The accident took place on the Nizomi Ganjavi Street near Chamanoro Restaurant on June 21 at around 5:20 pm.

BMW driven by Orzoubek Habibzoda went into oncoming traffic and crashed into Mercedes driven by Yusuf Zabirov.

As a result of the collision, the Mercedes driver and one of his passengers – Nozim Sharipov, 30 – died on the spot, while his two other passengers – Mahmadrahim Nematulloyev, 34, and his minor son Mahmoud, 3 (all of them are residents of Roudaki district) – died from sustained critical injuries in a hospital. 

The BMW driver Orzoubek Habibzoda, 39, and his 42-year-old passenger Suhrob Sultonov sustained various injuries and were taken to a hospital.

The cause of the accident is under investigation. 

The Dushanbe Mai Police Directorate says the Dushanbe Prosecutor’s office have instituted criminal proceedings against Habibzoda under the provisions of Article 212 (5) of Tajikistan’s Penal Code -- violation of the rules of the road, negligently resulting in the death of two or more persons, committed by a person in a state of intoxication committed or by a person without a driver's license.

If convicted, Orzoubek Habibzoda could face a prison term ranging from ten to fifteen years.  He will also be barred from holding certain positions or being engaged in certain activities for a period of ten to twenty years.
